Article 1 – Definitions
In these conditions, the following terms shall have the meanings hereunder:
Sunday Shades: The user of these general terms and conditions and provider of products via the webshop.
Buyer: The natural or legal person who enters into an agreement with Sunday Shades.
Consumer: The Buyer who is not acting in the exercise of a profession or business.
Agreement: The distance purchase agreement concluded via the webshop.
Article 2 – Applicability
These conditions apply to every offer from Sunday Shades and to every agreement concluded between Sunday Shades and the Buyer.
Before the agreement is concluded, the text of these general terms and conditions will be made available to the Buyer.
Article 3 – The Offer
If an offer has a limited validity period or is made under certain conditions, this will be explicitly stated in the offer.
Sunday Shades is not bound by obvious errors or mistakes in the offer (such as evident pricing errors).
Product images are a truthful representation, but may differ slightly from reality.
Article 4 – The Agreement
The agreement is concluded at the moment the Buyer completes the order and meets the conditions set for it.
Sunday Shades will promptly confirm receipt of the order by electronic means.
Article 5 – Right of Withdrawal (Returns)
The Consumer has the right to dissolve the order up to 14 days after receipt without stating reasons.
During this period, the Consumer will handle the product and packaging with care. The product may only be unpacked to the extent necessary to determine the nature and characteristics of the product.
If the Consumer exercises the right of withdrawal, the costs of return shipment shall be borne by the Consumer, unless stated otherwise.
Sunday Shades will refund the full order amount including the original shipping costs within 14 days after notification of the return, provided the product has been received in good condition.
Article 6 – Price, Payment, and Shipping Costs
All stated prices include VAT.
The specific shipping costs for an order will be clearly communicated during the ordering process (checkout).
The Buyer must make payment using the payment methods offered in the webshop.
Article 7 – Delivery and Execution
Sunday Shades will exercise the utmost care in executing orders.
Delivery takes place at the address provided by the Buyer.
If a delivery is delayed, the Buyer will be notified no later than 30 days after the order. In that case, the Buyer has the right to dissolve the agreement free of charge.
Article 8 – Warranty and Conformity
Sunday Shades guarantees that the products comply with the agreement and the stated specifications.
All Sunday Shades sunglasses come with a 1-year manufacturer's warranty. This warranty covers manufacturing defects and material defects under normal use.
The statutory warranty period remains in full force in addition to the manufacturer's warranty.
Article 9 – Complaints Procedure
Complaints about the execution of the agreement must be submitted fully and clearly described within a reasonable time after the Buyer has discovered the defects.
Submitted complaints will be answered within a period of 14 days after receipt.
Article 10 – Applicable Law
Agreements between Sunday Shades and the Buyer to which these general terms and conditions relate are exclusively governed by Dutch law.
